Terms and Conditions

Standard Terms and Conditions

All data provided is securely held in the PlasTeam office and will be treated confidentially and appropriately in carrying out the ongoing business of the PlasTeam.

The data is for the use of the PlasTeam and will not be disclosed to external organisations, other than those acting on behalf of PlasTeam (acting as agents for the University of Warwick, Warwick Manufacturing Group).

Data will be utilised for a full range of activities, including mailing publications, notification of events and of programmes involving networking and for the promotion of benefits and services.

Under the terms of the 1998 Data Protection Act you have the right to object to the use of your data for any of the above purposes.

In using this website, you agree to be bound by the terms and conditions (the "Terms") set out below. If you do not agree to the Terms then you may not use this website, its subsequent Cluster(s) or any part of.

Any services which we make available to you on or via the website and/or Cluster(s) may be subject to additional terms and conditions (the "Additional Terms") which are in addition to and may supplement or amend these Terms and which you will be required to accept when using this website and/or Cluster(s)

Definitions

"Cluster" means any web based business or sub web operated by PlasTeam set up through the tools provided on the PlasTeam Website.

"You/Your" means you, the user of this Website.

"User Information" refers to information provided by you via the Website and/or Cluster(s) and / or information provided by you via the Competence Profiling Questionnaire.

"We/Us/Our" means PlasTeam, part of Warwick Manufacturing Group (WMG), University of Warwick, who provide this Website and, who provide the Cluster(s).

Entry of data records

When you initially enter the PlasTeam web-site, we ask you to enter your name, company details and additional information. The on-line 'registration' form is confidentially and the information that you have provided will be destroyed after 3 years. However, PlasTeam can utilise the data in an anonymous manner to generate management statistics.

Before you utilise some of our services we may ask you to provide PlasTeam with additional details about your company background. The proviso of such information is voluntary but may help us to provide you better assistance. Any written form of advice, which we may provide, is available for you to examine until confidentially destroyed after 3 years.

Registration

You warrant, represent and undertake that the User Information which You are required to provide when You register is true, accurate, current and complete in all respects and You agree to notify Us as soon as possible of any changes to the User Iwion by amending Your User Information online by accessing the 'Edit Profile' Link at the top section of the Website. In terms of the Competence Profiling Questionnaire information please notify info@expertteammaker.com for further details on how to update this section.

You will be required to select a username and password during the registration process. You are responsible for maintaining the confidentiality of the username and password and are fully responsible for all activities which occur under them during Your use of the Website.

You agree to notify info@expertteammaker.com immediately of any unauthorised use of Your username or password or any other breach of security of which You become aware.

We reserve the right to decline any application from You to subscribe to the Website and/or Cluster(s) in Our sole discretion.

You agree not to impersonate any other person or to use a false name or a name that You are not authorised to use.

Visitation / correspondence records

Any correspondence and visitation reports will be held by PlasTeam. These are reviewed on a yearly basis. Confidential and routine correspondence is centrally filed and destroyed after a period of 3 years.

Our Obligations to You and Limitations on Liability

We aim to achieve 99.99% resilience from 9am-6 pm Mon-Fri (i.e. UK working week). We are confident of this resilience, check its content and data for integrity on a regular basis and are confident in its performance but we cannot guarantee that the Website and/or Cluster(s) will always be fully operational or error free and so We do not accept responsibility for any defects that may exist or for any costs, loss of profits, loss of data or consequential losses arising from Your use of or inability to access the Website and/or Cluster(s).

We make no warranty that the Website and/or Cluster(s) will meet Your requirements or will be uninterrupted, timely, secure or error-free, that defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, reliability of the materials or as to results or the accuracy of any information obtained by You through the Website and/or Cluster(s).

Whilst We take reasonable precautions to ensure that any downloads We make available will be virus free We do not warrant that any downloads will be virus free and will not cause interruptions with Your computer systems.

We do not review, assess or endorse any of the material submitted to Us and/or posted on the Website or Cluster(s) including the accuracy or reliability of any text, information, data, photographs, graphics, advertisements, promotions, representations, statements or other material whatsoever.

We exclude, to the fullest extent permitted by applicable laws, and save in respect of death or personal injury arising from Our negligence, all liability for any claims, losses, demands and damages arising directly or indirectly out of or in any way connected with the Website or Cluster(s). We may provide links to other Websites or resources (such as auctions, bazaars, non competence profiled company information) and may post, accept the posting of or make available content provided by third parties ("Third Party Content") whether or not that Third Party Content is hosted within Cluster(s). We do not accept responsibility for the Third Party Content and do not and cannot be deemed to have endorsed any Third Party Content. In particular, You acknowledge that We will not be party to any transaction or contract with a third party that You may enter into and that We shall have no liability to You in respect of any such transaction, whether arising in contract, tort, under statute or otherwise. You undertake that You will not involve Us in any dispute between Yourselves and the third party.

Automatic collection of information

We automatically log personal data by means such as programming or we link information automatically logged by such means with personal data about specific individuals. We do so for the following reasons:

What PlasTeam collect

In common with the vast majority of web sites, we record the IP addresses of all machines accessing our servers. In addition to this, there are several parts of the site where you must fill in forms, for example registering, accessing tenders and performing partnership search, we will also hold this data. In conjunction with this, we also record all major transactions. This record of data transaction is only used by PlasTeam staff for anonymous audit data. Through this record, individual transactions may be confirmed to help a registered user, or to protect registered users in the event of disputes. No information relating to your individual transactions will be revealed to other users without your permission (refer to Privacy Policy).

We use session files, along with cookies, to log some of your browsing patterns and so identify the areas of the site which have been of interest to you. This will permit us view the amount stored in a cluster or project space, to see if it has been accessed and utilised, or if the space is of no value.

We also use information in aggregate form (in other words, no individual user is identified) to:

· To build up marketing profiles

· To allow us to develop the PlasTeam in ways that assist you

· To audit usage of the site.

· All personal, cookie and session ID information are made available to PlasTeam employees and those acting on behalf of the PlasTeam, to enable us and any related third parties to deal more effectively with any enquiry you make.

Disclosure and visitor choice

We do not disclose your personal data to other organisations but may email or post information to you from ourselves or on behalf of other organisations. You have the right to opt out of these mailings. We may collect and use other statistical information about user behaviour to analyse the popularity and effectiveness of our website. In performing such analysis and in the course of our activities we will only disclose such information in an aggregated form that is not capable of identifying an individual user.

PlasTeam record system

We use the PlasTeam record system to store and retrieve information that you choose to provide us about your company. We also collect information supplied by you as part of our requirement to provide information to the European Regional Development Fund. The data will be used for quality assurance purposes to provide a statistical analysis reflecting the accuracy of data and population. The PlasTeam are responsible for maintaining this data and producing management information reports in anonymised form for both the ERDF and the PlasTeam. The data we collect is invaluable to the ERDF and without ERDF funding PlasTeam will no longer prevail The type of information that is collated for ERDF purposes is the SME Eligibility; Beneficiary Time Sheets; and Benefit Received. This entails a register of SME that are assisted; individual registration of SME showing name and address of SME, which demonstrate that the main trading address within Objective 2 region; evidence that the SME meet the SME definition; analysis of the need for intervention; statement of the type of assistance required; intervention plan and log; documentation of intervention provided (for example: meeting notes, correspondence, diary entries, intervention agreement and terms of intervention); and tracking of intervention results.

Specific information we record and collect about your transactions, directly relates to your security and ERDF funding requirements. All information collated and recorded is only used by PlasTeam staff for anonymous audit data. Recorded data transactions of tenders comprise of: tender submissions; tender approval; tender view; tender respond; expiration of tenders; deletion of tenders; tender team; close of negative tenders; close of positive tenders; and close of neutral tenders. Recorded data transactions of company, comprise of: submission of company; company approval; rated company; disabled company; add company user; and delete company user. Recorded data transactions of user, comprise of: user submit; approval of user; and user disable. Recorded data transactions of project, comprise of: project submissions; project approval; and project disabled. Recorded data transactions of cluster, comprise of: cluster submission; cluster approval; and cluster disabled. Recorded data transactions of product, comprise of: product created; product modify; product view; product order; and product deleted. Recorded data transactions of the basket, is the basket order. Recorded data transactions of auction, include created auction; auction view; auction bid; auction resolve; auction pre-auction buy; and deleted auction. Recorded data transactions of bazaars includes: bazaar created; bazaar view; bazaar offer; bazaar resolved; and bazaars delete. Recorded data transactions of role, consist of role created; role deleted; add user role; and delete user role. Recorded data transactions of portal reporting include add company and delete company.

Our Rights (PlasTeam)

We reserve the right to:

· deny or suspend Your access to the Website and/or Cluster(s) or any part thereof if Your use of the Website and/or Cluster(s) or that part is deemed by Us abusive, excessive, or against the interests of other users or in breach of these Terms;

· Modify or withdraw, temporarily or permanently, the Website and/or Cluster(s) (or any part thereof) with or without notice to You and You confirm that We shall not be liable to You or any third party for any modification to or withdrawal of the Website or Cluster(s);

· Change these Terms from time to time, and Your continued use of the Website and/or Cluster(s) (or any part thereof) following such change shall be deemed to be Your acceptance of such change. It is Your responsibility to check regularly to determine whether the Terms have been changed. If You do not agree to any change to the Terms then You must immediately stop using the Website and/or Cluster(s); and/or

· Refuse to place any content or material provided by You onto the Website and/or Cluster(s) in Our sole discretion and to remove any content or material from the Website and/or Cluster(s) once uploaded in Our sole discretion.

General

If any part of the Terms shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed to be severable from the Terms and shall not effect the validity and enforceability of any of the remaining provisions of the Terms.

No waiver by Us shall be construed as a waiver of any proceeding or succeeding breach of any provision.

Each provision of the Terms shall be construed as separately applying and surviving even if for any reason one or other of those provisions is held to be inapplicable or unenforceable in any circumstances.

The Terms (as amended from time to time) contain the entire agreement between the parties relating to the subject matter covered and supersedes any previous agreements, arrangements, undertakings or proposals, written or oral, between the parties in relation to such matters. No oral explanation or oral information given by any party shall alter the interpretation of the Terms. You confirm that, in agreeing to accept the Terms, You have not relied on any representation save insofar as the same has expressly been made a representation in the Terms and You agree that You shall have no remedy in respect of any misrepresentation which has not become a term of the Terms save that Your agreement shall not apply in respect of any fraudulent or negligent misrepresentation whether or not such has become a term of the Terms.

The Terms shall be governed by and construed in accordance with the laws of England and You irrevocably submit to the exclusive jurisdiction of the courts of England .

Confidentiality/Security

We have implemented security policies, rules and technical measures to protect the personal data that we have under our control from:

Auctions and Bazaars Terms and Conditions


Please take time to read these terms and conditions it is important that you understand our relationship relating our obligations to your use of the Auction and Bazaar pages of PlasTeam.

Our Auction and Bazaars operate as an introductory agent. This means that we accept submissions from registered third party suppliers, such as a manufacturing SME who wishes to sell surplus stock, etc. What this explicitly means, is that the contract for the product is between you and the supplier, and is not contractually obligatory to PlasTeam. In most cases this will mean that there are additional terms and conditions governing the contract, as each supplier will have terms and conditions relating to the particular product at Auction or Bazaar; i.e. this may mean it does not include delivery costs, etc. Please make sure that you have contacted the seller (supplier); and fully accept their terms and conditions before completing your bid transaction with us.

We act solely as an agent, which means that we have no contractual liability to you in respect of that product. As we act as an agent, you must verify all details with the third party seller (supplier) before submitting your bid. This may include what items are for sale, any additional costs, transportation, delivery, payment, etc. The third party seller (supplier) must stipulate the correct information of items being placed on Auction or Bazaar. PlasTeam will not misrepresent any information supplied for Auction or Bazaar and will not accept any contractual obligations.

All products sold through PlasTeam Auction and Bazaar, are purely an invitation to you, to make an offer to our third party sellers (suppliers). Once a bid is placed, the third party seller (supplier) is free to accept that offer or to reject it. We will send you an e-mail to state whether your offer has been accepted or rejected. If your bid has been accepted, please contact the third party seller (supplier) to confirm your purchase and additional delivery, collection, payment agreements.

The contract for any products at auction or bazaar is strictly between you and the third party seller (supplier), any queries or concerns relating to the product should be addressed to them. You will see the e-mail address for all suppliers, within each item page. We will of course assist you with supplier contact information, if more is required - please contact info@expertteammaker.com

PlasTeam will not ask for any payments regarding an item at Auction or Bazaar. This specifically is an undertaking between the third party seller (supplier) and yourself after your bid has been successful.

If there are any changes to the details supplied to PlasTeam by you, it is your responsibility to inform PlasTeam via our web form, or by contacting our help as soon as possible.

PlasTeam will not send you e-mails which you do not want to receive (see main Terms and Conditions for full details); but we can not guarantee that third parties to whom your details are sent to via Auction and Bazaar will adhere to our procedure.

PlasTeam will do our very best to correct errors and omissions as quickly as practicable possible, after being notified of them. However, if a third party seller (supplier) amends items after an auction or bazaar has started, the auction / bazaar will close. As a user placing a bid on auction/ bazaar, you have a pop-up that asks whether you wish to confirm the bid. Once you have answered yes to confirm, we will not make amendments to your bid. If in the unlikely instance that a system error transpires, we reserve the right to cancel that contract. If the contract is cancel, you will not have any liability.

The winning bid in any auction / bazaar will be the highest bid which exceeds the reserve and meets any other conditions of the relevant auction. If your bid wins or is accepted, PlasTeam will send you an e-mail confirming acceptance. If your bid is followed by a higher bid which is later removed by PlasTeam for any reason, it will be open to the vendor to accept your bid, as if the higher bid had never been made. PlasTeam reserves the right to refuse or remove bids, including those of disputes or which fail to reach the reserve. Each auction / bazaar is conducted in a single currency, which is British Pound Sterling.

By bidding on a PlasTeam auction / bazaar you agree that the auction will be governed by the rules in this Section.

Please note only registered users of PlasTeam can partake in the auction / bazaar process. Every user of the PlasTeam is required to complete a registration process prior to any bid.

Privacy Policy

We in the PlasTeam at the University of Warwick recognise that your personal privacy is a serious and important issue and we support the principle of protecting your privacy in all your dealings with us.

By using our services you consent to the collection and use of your personal information in accordance with this policy. Though the policy has been developed to take account of changes in the many different ways you may wish to use our services, it is subject to change and any such changes will only be notified on our web site.

What information will be requested? How will it be used?

We take Your privacy seriously. During registration personal information will be requested such as Your email address. Our aim is to understand what You want from the Website and Cluster(s) and to improve Our services to You.

All those wishing to become registered users or members of the PlasTeam network need to submit their e-mail addresses and additional details. Submission of Your e-mail address enables us to contact you at any time and also gives WMG the potential to establish newsletter services and other e-mail based services to enhance your Cluster(s) experience.

WMG may also collect aggregate data based upon site usage. These data allow WMG to assess the popularity of certain areas of the Website and Cluster(s) and raise the level of service performance which WMG provides for you. Such information also allows WMG to inform potential advertisers and selected third party service providers of areas of Cluster(s) which are most suitable for their banners, products and services. These data are collected using "cookies".

A cookie is a piece of information that is stored on Your computer's hard drive by Your web browser. On revisiting the Website and/or Cluster(s) WMG computer server will recognise the cookie, giving WMG information about Your last visit. Cookies do not store or reveal any personal information about You. Most browsers accept cookies automatically, but usually You can alter the settings of Your browser to prevent automatic acceptance. Prohibiting the use of cookies will reduce your networking experience.

Disclosure to outside parties

We do not pass, sell, trade or rent personal details entered on this Website or Cluster(s) to others. WMG may chose to do so in the future, but only with selected third parties who provide goods and services which WMG deem of interest to users. WMG may also provide aggregate statistics about users, their usage behaviour and related site information to reputable third parties, and WMG may release personally identifying information concerning defined groups of users. You are able to exclude Yourself from receiving any third party information, or from having Your personal information released, through both the online application process and via the "My profile" option within the Personal Options area of the members homepage, accessible upon registration.

You agree that You do not and will not consider anything in this privacy policy being a breach of any of Your rights under the Telecommunications (Data Protection and Privacy) Regulations 1999.

We reserve the right to access and disclose individually identifiable information to comply with applicable laws and lawful government requests, to operate our systems properly or to protect ourselves or our users. Technicalities of Information

The Data Controller is the person who (either alone or jointly or in common with other persons) determines the purposes for which, and the manner in which, any personal data are, or are to be, processed.

Personal Data refers to data which relates to a living individual who can be identified from those data or from those data and other information which is in the possession of, or likely to come into the possession of a data controller.

Processing refers to obtaining, recording or holding the data or carrying out any operation or set of operations on the data. It includes organising, adapting, and amending data, retrieval, consultation and use of data, disclosure and erasure or destruction of the data. It is difficult to envisage any activity involving data which does not amount to processing.

Data Protection Principles

There are eight principles contained in the 1998 Data Protection Act which serve as the rules on how data may be processed.

· Adequate, relevant and not excessive;

· Not kept longer than is necessary;

· Processed in accordance with the data subjects rights;

· Not transferred to a country or a territory outside the European Economic Area (EEA) unless that country or territory ensures an adequate level of protection.

Data Notification

The PlasTeam has an obligation, on an annual basis, to inform the University of Warwick and the Information Commissioner's Office of the purposes for which personal data is processed together with the types of individuals who are the subject of the data (data subjects), the types of data being processed (data classes), the individuals or organisations to which the University does or intends to disclose data and the countries to which, if any the data is transferred.

Transfer of Data to Third Parties

Personal data must not be disclosed to unauthorised third parties (including family members):

a) unless the data subject consents to the disclosure;

(Note, consent cannot be inferred from silence, therefore if consent from the subject is sought but no reply is received then the information cannot be released).

b) or the disclosure:

· is necessary to protect the vital interests of the data subject (e.g. where failure could result in harm or death);

· is necessary to prevent serious harm to a third party;

· is necessary for national security;

· is necessary for the prevention of crime or prosecution of offenders;

· is necessary for the assessment/collection of taxes or duty;

· is necessary for the discharge of regulatory functions including securing the health, safety and welfare of persons at work;

· is required by legislation, by rule of law or by order of the court.

· is used for research purposes, subject to the specific rules shown under the heading "Use of Personal Data in Research", below.

In all cases staff should obtain written proof from a third party requesting data.

Use of Personal Data in Research

The 1998 Act provides certain exemptions that allow staff and students of the University of Warwick to use personal data for research purposes. If the purpose of the research processing does not involve measures or decisions targeted at particular individuals and a reasonable judgement has be made that it does not cause substantial distress or damage to data subjects, the data:

· may be used for a purpose other than that for which it was originally obtained (i.e. it is exempt from the Second Data Protection Principle);

· the data may be held indefinitely (i.e. it is exempt from the Fifth Data Protection Principle);

· is exempt from the subjects rights of access to his/her to copies of the personal data where the results do not identify specific individuals.

All other principles of the Act apply and researchers and staff are to ensure that the principles are, and can be, conformed to before processing research data.

Security

A data subject may apply to the court for compensation if he/she has suffered because personal data have been lost, destroyed or disclosed without the authority of the data user (please refer to Auction and Bazaar).

PlasTeam staff therefore have an obligation to ensure:

· a level of security appropriate to the risks represented by the processing and the nature of the data to be protected;

· that security is ensured regardless of where or by whom the data is stored, processed or transmitted;

· that there are clear lines of responsibility and that people handling or processing data are aware of their responsibilities for data security.
